These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Utah, without giving effect to any choice-of-law provisions.
You and MyJobResource.com agree that any and all disputes, claims, or controversies arising out of or relating to your access to or use of the Website, or to any products or services offered, sold, or purchased through the Website, shall be resolved exclusively through final and binding arbitration, rather than in court, except for qualifying claims that may be filed in small claims court. The Federal Arbitration Act (FAA) governs this Agreement to Arbitrate.
You and MyJobResource.com agree that all claims shall be brought only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. Unless both parties agree otherwise in writing, the arbitrator shall not consolidate or join claims or preside over any class or representative proceeding.
The arbitrator may award relief only to the individual party seeking it, and only as necessary to resolve that party’s individual claims.
Arbitration shall be administered by the American Arbitration Association (AAA) in accordance with its rules, including the Supplementary Procedures for Consumer-Related Disputes, as modified by this Agreement. The AAA’s rules are available at www.adr.org.
Unless otherwise agreed, arbitration shall occur in the county of your residence or another mutually agreed location. If the amount in dispute is $10,000 or less, either party may elect arbitration by telephone, in writing, or in person.
The arbitrator shall apply the substantive law of the State of Utah, and any award shall be final and binding.
Except as otherwise provided by the AAA’s rules, MyJobResource.com may, at your written request, pay all arbitration fees if the amount in dispute is $10,000 or less. For larger claims, MyJobResource.com shall pay the portion of costs the arbitrator deems necessary to avoid making the arbitration cost-prohibitive.
If the arbitrator determines your claim is frivolous, you agree to reimburse MyJobResource.com for any fees paid on your behalf.
Except as required by law, arbitration proceedings and awards shall remain strictly confidential, except for disclosures to attorneys, tax or financial advisors, and, for individuals, immediate family members.
If any part of this Agreement to Arbitrate is found invalid or unenforceable, the remainder shall remain in effect, except that if the prohibition of class or representative actions is held invalid, this entire Agreement to Arbitrate shall be null and void.
